01. Introduction
These Terms of Use explain the conditions that apply when you browse the Maison Eclet storefront, create or use an account, add products to a cart, place an order, complete checkout, contact support, or access customer order information.
These terms are written for a perfume e-commerce storefront serving customers in Portugal and the European Economic Area. They should be read together with the Privacy Policy and with any product, price, payment, delivery, and return information shown before checkout confirmation.
By using the storefront or placing an order, you agree to follow these terms. If you do not agree, you should not place an order through the Maison Eclet website.
02. Merchant and Contact
Maison Eclet operates a curated perfume storefront. The final registered legal entity name, business address, VAT or tax identification details, and required merchant information should be confirmed by the client before production publication and added where applicable.

If support needs to identify an order, account, return, or complaint, we may ask for information reasonably necessary to verify the relevant purchase or customer context.

Storefront use
Customers may browse products, create an account, manage a cart, place orders, and contact support within the limits of lawful and fair use.
Product information
Descriptions, images, availability, prices, and catalog details are provided for purchase guidance and may change when stock or operational conditions require it.
Orders and checkout
Orders depend on successful cart validation, payment processing, stock availability, and the absence of obvious pricing or catalog errors.
Payment provider
Stripe is the current payment processor for the storefront unless a different provider is later configured for production.
Consumer rights
EU consumer rights may include withdrawal, legal guarantees, refunds, and complaint routes, subject to legal conditions and product-specific exceptions.
Perfume returns
Sealed perfume or hygiene-sensitive goods may be subject to withdrawal exceptions if unsealed, opened, used, damaged, or made unsuitable for resale.
Support context
Support may request order references, contact details, product information, and issue context to resolve customer requests.
04. How Orders Work
An order is submitted when you complete the required checkout steps and authorize payment through the storefront payment flow. The order process may require server-side validation of cart contents, product availability, price, payment state, and customer information.
- Adding a product to the cart does not reserve inventory indefinitely.
- The final checkout view should identify the payable amount before payment confirmation.
- Receiving an automated message does not always mean an order has been finally accepted or fulfilled.
- Order acceptance may depend on payment confirmation, fraud checks, inventory availability, and the absence of obvious errors.
- If we cannot accept or fulfil an order, we will contact you where practical and handle any payment reversal or refund required by applicable law.

05. EU Consumer Foundations
These terms are intended to operate within Portuguese and European consumer-law expectations for an online perfume storefront. The exact final wording should be reviewed after the client confirms the registered business details, fulfilment model, delivery countries, and return process.
Pre-contract information
Customers should receive clear information about key product, price, payment, delivery, and trader details before committing to an online order.
Withdrawal rights
Many EU online purchases include a 14-day withdrawal period, subject to legal exceptions and national implementation rules.
Sealed goods exception
Goods sealed for health protection or hygiene reasons may be excluded from withdrawal when unsealed after delivery, where the legal conditions apply.
Legal guarantee
EU consumer rules include protection for goods that are faulty, not as described, or not in conformity with applicable expectations.
06. Prices, Taxes, and Payment
Prices are shown through the storefront and may include or exclude taxes, delivery costs, duties, or other charges depending on the checkout configuration and the customer's location. The final payable amount should be shown before the order is confirmed.
Payments are processed through Stripe or another payment provider confirmed for the production storefront. Maison Eclet does not intentionally store full card numbers or card security codes in the application database.
- Where VAT, duties, or delivery costs apply, they should be presented before the customer commits to the order.
- Payment authorization, fraud checks, payment confirmation, refunds where applicable, and disputes may be handled by the payment provider.
- Maison Eclet may store order records, checkout references, payment status, account linkage, and item details needed for order reconciliation.
- We may correct obvious pricing, typographical, catalog, or technical errors in a way that respects applicable consumer law.
07. Delivery and Fulfilment
Delivery options, estimated timing, costs, restrictions, and fulfilment details should be shown during checkout or communicated through support where applicable. Because shipping rules depend on the final business setup, the storefront should not be understood as promising a specific carrier, delivery estimate, or shipping method unless it is explicitly shown before checkout confirmation.
Risk and responsibility for goods pass according to applicable consumer law and the delivery information provided at checkout. If an order appears delayed, lost, damaged, or incorrectly fulfilled, contact support with the relevant order reference.
- The client should publish final delivery countries, restrictions, and costs before production go-live.
- Customers are responsible for providing accurate delivery and contact information where delivery information is requested.
- If delivery cannot be completed due to incorrect or incomplete information, support may need to contact the customer before further action is taken.
- Shipping, carrier integrations, and delivery-rate automation are not currently promised by these terms unless added to the storefront later.
08. Returns, Refunds, and Complaints
If you are an EU consumer buying online, you may generally have a right to withdraw from a distance purchase within the applicable statutory period. For many online purchases, this period is 14 days from receiving the goods, subject to legal exceptions and national implementation rules.
Perfumes, cosmetics, and similar sealed goods may be subject to exceptions when they are sealed for health protection or hygiene reasons and are unsealed after delivery. This means a product that has been opened, unsealed, used, damaged, or made unsuitable for resale may not qualify for withdrawal in the same way as an unopened product.
- Contact support before returning a product so the order and return context can be identified.
- Keep the product, packaging, order confirmation, and proof of purchase where possible.
- Do not send opened or unsealed fragrance products unless support confirms the return route and legal basis.
- Refunds, replacements, or other remedies will be handled according to applicable law, product condition, and payment-provider constraints.
- For customers in Portugal, the client should confirm whether the final website must identify Livro de Reclamações Eletrónico details or alternative dispute resolution information.
09. Legal Guarantee and Faulty Goods
EU consumer rules include a legal guarantee for goods that are faulty, not as described, or do not work as expected under applicable law. This guarantee is separate from any commercial gesture or voluntary brand warranty.
If you believe a Maison Eclet product is damaged, faulty, incorrect, or not as described, contact support with the order reference, product details, and photos where relevant. We may need to inspect the issue and determine the appropriate legal remedy, such as repair, replacement, price reduction, refund, or another remedy required by applicable law.
10. Customer Responsibilities
Customers are responsible for using the storefront lawfully, providing accurate account and order information, protecting account credentials, and reviewing order details before submitting payment.
You must not impersonate another person, use another person's account without permission, manipulate checkout or pricing, abuse password recovery, interfere with security controls, or use the storefront for fraudulent, automated, harmful, or unlawful activity.
11. Intellectual Property
The Maison Eclet name, brand presentation, fragrance storytelling, product imagery, interface design, text, graphics, and other storefront materials are owned by Maison Eclet or its licensors unless otherwise stated.
You may use the storefront for personal browsing and purchasing. You may not copy, reproduce, scrape, resell, modify, distribute, or commercially exploit the storefront content without permission, except where mandatory law permits it.
12. Third-Party Services
The storefront may rely on third-party providers for hosting, authentication, database operations, payment processing, email, support, or operational infrastructure. Third-party services may have their own terms and privacy notices when they process data independently or provide customer-facing payment pages.
We are not responsible for third-party websites or services that are outside our control, but we aim to use providers that support the current storefront safely and reliably.
13. Support Communications
Maison Eclet may send transactional messages connected to your account, password recovery, checkout, order status, support request, payment state, return request, or security notice. These messages are part of operating the storefront and may be necessary even if marketing messages are not active.
If the storefront later offers newsletters, launch notices, or promotional messages, the client should confirm the appropriate consent and opt-out flow before production use.
14. Service Availability
The storefront is provided with reasonable care for the current e-commerce scope. We do not guarantee that the site will always be uninterrupted, error-free, or compatible with every device, browser, or network condition.
We may suspend, update, correct, or restrict parts of the storefront when needed for security, maintenance, legal, fraud-prevention, payment, inventory, or operational reasons.
15. Liability and Mandatory Rights
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including mandatory consumer rights, liability for fraud, or other liability that cannot be excluded under applicable law.
Any limitation in these terms should be read in a way that respects mandatory Portuguese and EU consumer protections that apply to customers and cannot be waived by contract.
16. Privacy
Personal data is handled according to the Maison Eclet Privacy Policy. The Privacy Policy explains what data may be collected, why it is used, which providers may be involved, and how EU/EEA customers can exercise privacy rights where applicable.
17. Changes to These Terms
We may update these terms when the storefront changes, when legal requirements change, when provider relationships change, or when operational practices are clarified. The latest version will be posted on this page with an updated date.
Changes will not reduce mandatory consumer rights. If a change materially affects an order already accepted, the version applicable at the relevant time and mandatory law will guide the handling of that order.
